Terms of Service

1. Purpose

The platform acts only as an intermediary and does not provide medical services.

2. Role of the platform

The platform allows:

• the search for psychologists
• connections between users
• contact between patients and psychologists

The platform does not intervene in the therapeutic relationship between the parties.

3. Responsibility of psychologists

Psychologists present on the platform are independent. They are solely responsible for:

• the services they offer
• their qualifications
• their professional practice

The platform does not guarantee the outcomes of consultations.

4. Responsibility of patients

Patients agree to:

• provide accurate information
• use the platform respectfully
• not harass or abuse professionals

5. No medical relationship with the platform

The platform does not constitute a medical service. It does not replace:

• a medical diagnosis
• therapeutic follow-up
• medical treatment

In the event of a medical or psychological emergency, users must contact the appropriate emergency services.

6. Account creation

The user is responsible for:

• the confidentiality of their credentials
• any activity carried out through their account

The platform may suspend an account in the event of a breach of these terms.

7. Messaging

Internal messaging must:

• be used respectfully

Abuse may lead to suspension of the account.

8. Limitation of liability

The platform cannot be held responsible for:

• interactions between users
• consultations carried out outside the platform
• therapeutic decisions made by professionals

9. Account deletion

Users may delete their account at any time, except if, as a psychologist, they have a paid account. In that case, they must cancel their paid subscription before they can delete their account.

The platform reserves the right to suspend or delete an account in the event of abuse.

10. Use of Yuna

Yuna is an automated artificial intelligence assistant providing general support and orientation assistance. Its use is optional.

• Yuna is neither a psychologist nor a healthcare professional and does not provide diagnoses, treatments or medical advice
• Yuna responses are generated automatically and may be inaccurate, incomplete or unsuitable for the user's situation
• Yuna does not replace a consultation, therapeutic follow-up or advice from a qualified professional
• content or psychologist suggestions are indicative and do not guarantee compatibility with a professional or any therapeutic outcome
• Yuna is not an emergency or crisis service
• Yachay may limit, suspend or modify access to Yuna, including for security, maintenance or abuse-prevention purposes

In an emergency, immediate danger or risk of self-harm, users must immediately contact emergency services or an appropriate human support service.

11. Applicable law

These terms are governed by Belgian law.

Any dispute will be submitted to the competent courts.

12. Psychologist subscription and price

The subscription costs €19.99 excluding VAT per month. Belgian VAT is 21% (€4.20), for a recurring total of €24.19 including VAT.

• the first €24.19 payment covers the first full month and creates the mandate used for later collections
• the subscription renews automatically each month until cancellation
• Yachay is the seller and contractual counterparty; Mollie is the external payment processor and is not the seller or Merchant of Record
• the psychologist is redirected to Mollie’s hosted checkout and authorises recurring payments
• changing the payment method requires a €0.01 verification payment, which is credited and deducted from the next subscription charge

13. Confirmation, invoices and payment incidents

A payment is successful only after Mollie and Yachay confirm it. Returning from checkout is not proof of payment.

• after confirmation, Mollie Invoicing issues the paid invoice, sends it by email and also delivers it through Peppol where legally required
• a pending, refused, failed or charged-back payment may suspend paid access and public profile visibility while dashboard access remains available
• invoices, credit notes and payment evidence are retained for applicable accounting and legal periods

14. Cancellation, resumption and refunds

Normal cancellation takes effect at the end of the period already paid, during which paid access continues.

• resumption is possible only while the paid grace period is running
• refunds are not automatic and are handled under applicable law and the circumstances of the request
• a refund changing an issued invoice results in a corresponding credit note

15. Cookies and marketing services

Accepting these Terms never constitutes consent to optional cookies or marketing services.

• We use Tarteaucitron to manage your cookies.
• refusing Google Ads, Meta Pixel or Microsoft Clarity does not prevent use of Yachay’s essential features
• preferences can be changed at any time through “Manage my cookies”

16. Psychologist presentation videos

Psychologists may optionally record a short presentation video intended to be displayed publicly on their Yachay profile.

• the psychologist understands that their video, image, voice and presentation will be accessible to visitors of their public profile
• the psychologist warrants that they hold all rights and authorisations required for the image, voice, statements and any other material included in the video
• the video must not contain any patient data, confidential information, third-party content used without permission, or any unlawful, misleading, discriminatory content or content contrary to the psychologist’s professional obligations
• the psychologist remains solely responsible for the accuracy of their presentation and for ensuring that its content complies with their legal, ethical and professional obligations
• the psychologist grants Yachay a non-exclusive, royalty-free licence, limited to the period during which the video is published, to host, encode, technically reproduce and distribute the video solely for the purpose of operating their public profile
• Yachay uses Cloudflare Stream as a technical service provider for uploading, encoding, storing, generating a thumbnail and delivering the video
• the psychologist may replace or delete the video from their profile; deletion initiates removal of the video from Yachay and from active storage held by the technical provider, subject to reasonably necessary technical delays
• Yachay may suspend or remove a video that breaches these Terms, the law, third-party rights or applicable professional rules

Yachay does not guarantee uninterrupted availability of the video player and may modify, suspend or replace the technical provider used for this feature.
